CONDITIONS FOR PRODUCTS AND SERVICES
The terms and conditions applicable to any product, service or information will be those determined at the time of provision of the product, service or information. The various products and services are being offered herein are with a specific understanding that the same are being availed within the frame work of the laws of India and / or are not opposed to / in contravention to public policy. Please be aware of the laws of your country or that otherwise apply to you in relation to any of the matters described in these pages. If you choose to access the Site, you do so on your own initiative and are responsible for compliance with applicable local, national or international laws.
The SmartWork Group will treat all information regarding you as confidential. SmartWork will not in the ordinary course disclose any information that it holds about you except in the following circumstances: 1. where SmartWork is compelled to do so under the Indian law; 2. where you have provided your prior written authorization to do so; 3. where it is in the interest of SmartWork to do so; or 4. where it is in the public interest to do so. 5. where SmartWork needs to disclose information to other financial institutions. SmartWork may be required to disclose information about you to third parties to facilitate the provision of services to you. You may not use or export or re-export the Information or any copy or adaptation in violation of any applicable laws or regulations, including export laws and regulations in force from time to time.
Use of Information Obtained by SmartWork.
Day Pass Cancellation/Refund Policy
In the case of cancellation of Work Space Solution, either by Smartwork or User the same shall also mean cancellation of services, amenities, products etc. offered by Smartwork. In case of breach of any terms and condition under Smartwork-User Agreement by the User, Smartwork shall have the right to terminate the Smartwork-User Agreement and /or deny access of User to the Work Space Solution. Such termination or denial of access shall result into cancellation of User’s booking by Smartwork. In case of any cancellation the current service tax rate on the advance will be retained by Smartwork as it is to be paid by it to the concerned authorities. The Credit Card/Debit Card charges and/or any other applicable taxes or charges on the amount not refunded to the User shall be charged to the User. The refund will be made in the same mode of payment used while booking. Smartwork will mediate when necessary, and has final say in all disputes. The booking is not officially cancelled until the User receives a cancellation confirmation through E-mail/SMS/Notification from Smartwork. In case confirmation of cancellation is not received by the User, it shall be the duty of User to contact and inform Smartwork about the same.
Guest And Visitor Policy
It is a set of guidelines applicable to User and its Guest/ Visitor under the terms of the Smartwork-User Agreement. User shall be free to invite its Guests and Visitors at Smartwork Work Space Solution. Guest shall mean a person who accompanies the User for a continuous duration of 1 hour or more and Visitor shall mean a person who visits the User for duration of 1 hour or less at the Smartwork Work Space Solution. Common Area shall mean the waiting area around the Smartwork reception excluding the areas dedicated for the use by Users. Dedicated User areas would include Meeting Room/ Lounge, Conference Room, Dedicated and non Dedicated workstations, Community area etc. Number of person/s permissible as User’s Guest/s shall depend upon the type and plan of booking by the User. User shall be responsible for booking sufficient Work Space Solution to entertain its Guests at the time of booking and Smartwork shall not be responsible for providing any additional space beyond the Common Area. Guests will be allowed in Common Area as per availability of space in Common Area subject to discretion of Smartwork. If the Guest stays for more than 1 hour without sufficient space being booked by the User, the User shall have to purchase day pass for its Guest. Day Pass shall mean an amount equivalent to the fee for booking a Daily Flexi Seating plan or the equivalent fee for booking a Meeting Room/ Conference Room subject to availibility of Work Space Solution and at the sole discretion of Smartwork. In the event of Sufficient Space being not booked by User and sufficient space being also not available for the purpose of Day Pass, the Guest shall not be allowed to stay at Work Space Solution for more than 1 hour. Guests and Visitors are required to adhere to the terms and conditions of the Smartwork-User Agreement. User shall ensure that its Guests and Visitors carry valid Identity Proof with them failing which they shall be denied access to Smartwork Work Space Solution. User shall be solely responsible for the actions and behaviour of its Guests and Visitors during their visit at Smartwork Work Space Solution.
SmartWork and any of its affiliates, subsidiaries, officers, directors, employees or agents provide the Site and the Information on an “as is” basis and do not make any express or implied warranties, representations, endorsements or conditions with respect to the Site or the Information, including without limitation, warranties as to merchantability, operation, non-infringement, usefulness, completeness, accuracy, current ness, reliability and fitness for a particular purpose. Further, SmartWork does not represent or warrant that the Site will be available and meet your requirements, that access will be uninterrupted, that there will be no delays, failures, errors or omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your computer system. You have sole responsibility for adequate protection and backup of data and/or equipment and to take reasonable and appropriate precautions to scan for computer viruses or other destructive properties.
The site may from time to time contain forward-looking statements that include information about SmartWork’s financial prospects, plans and objectives of management for future operations, economic conditions, trends and known uncertainties. The user is hereby cautioned that actual results could differ materially from those that SmartWork expects, depending on the outcome of certain factors. SmartWork does not undertake any obligation to correct or update any forward-looking statements on the site.

SmartWork reserves all copyright, trademark, patent, intellectual and other property rights in the information contained in this website and to all company specific logos and services logos and no express or implied license is granted in respect thereof. Any unauthorized access, use or reproduction of the information or proprietary rights contained in this site is strictly prohibited and is subject to such action as provided in applicable laws. No information on this website should be reproduced or distributed without the prior written consent of SmartWork. The Information is for your personal use only. Any unauthorized downloading, re-transmission, or other copying or modification of trade-marks and/or the contents of the Site may be a violation of any law that may apply to trade-marks and/or copyrights and could subject the copier to legal action.

SmartWork is not responsible for and will not be liable to you or anyone else for any damages whatsoever (including direct, indirect, incidental, special, consequential, exemplary or punitive damages) arising out of or in connection with your use of or inability to use the Site or the Information, or any action or decision made by you in reliance on the Site or the Information, or any unauthorized use or reproduction of the Site or the Information, even if SmartWork has been advised of the possibility of these damages.
SmartWork controls and maintains this site from India. SmartWork makes no representation that the information and material contained in this site is appropriate or permitted for use in jurisdictions outside India. The terms and conditions are governed by the laws of India without giving effect to any principles of conflicts of laws. The Site for the user subject to the exclusive jurisdiction of the courts of India without prejudice to the right of SmartWork to take an action in any jurisdiction whatsoever.
